Terms of Service

1. Acceptance of Terms
By engaging The Green Point to set up and operate a WhatsApp booking chatbot for your business (“Service”), you (“Business Client”, “you”) agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.
2. Description of Service
The Green Point builds and operates a custom WhatsApp booking chatbot for your business. The Service includes:
- Configuration and setup of a WhatsApp chatbot connected to your WhatsApp Business number.
- Automated appointment booking, rescheduling, and cancellation for your customers via WhatsApp.
- Booking notifications sent to you with approve/deny options.
- Google Calendar synchronisation for confirmed appointments.
- Automated appointment reminders sent to your customers.
- Ongoing hosting and maintenance of the chatbot.
3. Your Obligations
As a Business Client, you agree to:
- Provide accurate and up-to-date information about your services, staff, pricing, and business hours for chatbot configuration.
- Respond to booking requests within a reasonable timeframe.
- Maintain an active WhatsApp Business number for the duration of the service.
- Comply with all applicable data protection legislation, including the Protection of Personal Information Act (POPIA), regarding customer information received through the chatbot.
- Not use customer contact information obtained through the Service for unsolicited marketing without the customer's explicit consent.
- Not attempt to interfere with, reverse-engineer, or disrupt the Service's operation or infrastructure.
4. Setup & Onboarding
We will work with you to configure the chatbot based on the information you provide. Setup timelines depend on the complexity of your requirements and the completeness of the information supplied. You are responsible for granting us access to your WhatsApp Business account and Google Calendar as needed for configuration.
5. Bookings & Customer Interactions
The chatbot handles customer interactions on your behalf based on the configuration you approve. All bookings are subject to your explicit approval unless you opt in to auto-approval. The Green Point is not a party to the relationship between you and your customers. You remain solely responsible for the services you provide to your customers.
6. Limitation of Liability
The Green Point provides a technology service and is not responsible for:
- The quality, safety, or legality of the services you provide to your customers.
- Disputes between you and your customers.
- Service interruptions caused by third-party platforms, including WhatsApp (Meta), Google, or hosting providers.
- Missed bookings, scheduling conflicts, or other issues arising from incorrect or outdated information provided by you.
To the maximum extent permitted by South African law, our total liability shall not exceed the fees paid by you in the month preceding the claim.
7. Intellectual Property
All software, design, branding, and systems associated with The Green Point are our intellectual property. You retain full ownership of your business information, branding, and any customer data collected through the Service.
8. Termination
Either party may terminate the service arrangement at any time without penalty. Upon termination, the chatbot will be disconnected from your WhatsApp Business number. Data will be retained and handled as described in our Privacy Policy.
9. Governing Law
These Terms are governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of the Western Cape, South Africa.
10. Changes to These Terms
We reserve the right to update these Terms from time to time. Continued use of the Service following any changes constitutes your acceptance of the revised Terms. We will notify you of any material changes via email or WhatsApp.
